TERMS & CONDITIONS
This License Agreement (this “Agreement”) is made effective as of the Start Date (“Commencement Date”) by and between Signature Truck Parking ("Licensor") and the individual, company, or authorized agent signing this agreement (“Licensee”).
This Agreement grants a license to park and does not constitute a bailment or lease agreement.
1. PAYMENT TERMS: Licensee agrees to pay the monthly parking fee in full at the time of signing.
- First and last month’s payments are required at signing.
- No prorations or refunds are provided for partial months.
- Monthly payments must be made at least 7 days prior to the renewal date.
- Payments are processed via pre-authorized credit card, T-checks, checks, or cash.
- Prices are subject to change without notice, and any price adjustments will be reflected on the next billing cycle.
2. VEHICLE REQUIREMENTS & INSURANCE: All vehicles must be properly registered and insured. Licensee must provide proof of valid insurance and Driver’s License (CDL). See “Additional Terms” for insurance requirements.
3. HAZARDOUS SUBSTANCES & ENVIRONMENTAL LAWS: No hazardous materials (petroleum, waste, medical, radioactive, toxic substances, solid waste, or infectious waste, etc.) are allowed on the premises. See “Additional Terms” for specifics.
4. REFUND & CHARGEBACK POLICY: All sales are final. Refunds are granted only under limited conditions outlined in the Cancellation Policy. Chargebacks are prohibited. If a chargeback is initiated:
- The Licensee’s agreement is immediately void.
- Licensee is banned from future use of Signature Truck Parking facilities.
- Vehicles belonging to a Licensee who initiates a chargeback may be booted, towed, or impounded at Licensee's expense.
5. LATE PAYMENTS & NON-PAYMENT: A $25 late fee per vehicle is applied for payments more than 5 days late. After 14 days, the account converts to daily parking rates. After 30 days, the vehicle is considered abandoned and subject to towing, booting, or impoundment at Licensee’s expense.
6. CANCELLATION POLICY: Licensees must submit a cancellation form via Signature Truck Parking’s website at least 30 days before the next billing cycle. No verbal, phone, or email cancellations are accepted.
7. OVERAGE CHARGES: Any parking space use exceeding the agreed monthly terms will incur a charge of $35 per day. Overage fees are due immediately and become past due after 5 days.
8. ILLEGAL PARKING & VIOLATIONS: Unauthorized parking will result in immediate towing or booting. No "For Sale" signs are allowed on vehicles parked on the property. Vehicles parked without proper permits or beyond paid periods will be removed at Licensee's expense.
9. FACILITY REGULATIONS: No repairs (oil changes, tire replacements, mechanical work, etc.) are allowed. No littering is permitted. Gate codes are confidential and must not be shared. Sleeping in vehicles is strictly prohibited.
10. LIABILITY & DISCLAIMER: Signature Truck Parking is not responsible for theft, vandalism, or damage to vehicles or property. Licensee assumes full risk for parking on the premises.
ADDITIONAL TERMS
The following terms and conditions regarding insurance, hazardous substances, and environmental laws shall be met by the Licensee:
1. Insurance Requirement: Licensee must provide proof of auto liability insurance in order to complete an online reservation. The insurance must cover bodily injury and property damage claims arising from the ownership, use, or maintenance of any owned, hired, or non-owned automobiles with a combined single limit per accident of not less than $1,000,000.00 per occurrence.
2. Compliance with Environmental and Hazardous Substances Requirements:
a. Environmental Laws: The Licensee must comply with all federal, state, and local laws, statutes, rules, regulations, ordinances, and codes regarding the regulation or protection of human health, safety, the environment, and natural resources. These laws include, but are not limited to:
- The Comprehensive Environmental Response, Compensation, and Liability Act (42 U.S.C. § 9601 et seq.)
- The Hazardous Materials Transportation Act (49 U.S.C. § 5101 et seq.)
- The Clean Air Act (42 U.S.C. § 7401 et seq.)
- The Clean Water Act (33 U.S.C. § 1251 et seq.)
- The Safe Drinking Water Act (42 U.S.C. § 300f et seq.)
- The Solid Waste Disposal Act (42 U.S.C. § 6901 et seq.)
- The Resource Conservation and Recovery Act (42 U.S.C. § 6901 et seq.)
- The Occupational Safety and Health Act (29 U.S.C. § 651 et seq.)
- The Toxic Substances Control Act (15 U.S.C. § 2601 et seq.)
- The Emergency Planning and Community Right-To-Know Act (42 U.S.C. § 11001 et seq.)
- The Federal Insecticide, Fungicide, and Rodenticide Act (7 U.S.C. § 136 et seq.)
These laws and any similar or comparable state, federal, or local laws are applicable as of the date of this Agreement and shall apply as they are amended in the future.
b. Hazardous Substances: "Hazardous Substances" include:
- Any substances that fall under the definitions of "hazardous substances," "hazardous materials," "toxic substances," "solid waste," or "infectious waste" as defined in the Environmental Laws.
- Any substances, materials, or wastes that are or become regulated under applicable local, state, or federal law, or are classified as hazardous, toxic, or infectious under current or future Environmental Laws or other regulations.
c. Compliance:
- The Licensee, at their sole cost and expense, must promptly comply with any Environmental Laws that impose obligations related to the use, occupancy, maintenance, or alteration of the premises and that arise directly from the Licensee’s operations during the term of the Agreement.
- The Licensor/Landlord, at their sole cost and expense, must promptly comply with any Environmental Laws that impose obligations regarding the Licensor/Landlord’s use, occupancy, maintenance, ownership, or alteration of the premises.
d. Licensee’s Indemnification:
The Licensee agrees to defend, indemnify, and hold harmless the Licensor/Landlord, its officers, agents, employees, and directors from any and all claims, losses, liabilities, costs, expenses, or damages incurred by the Landlord in connection with any breach by the Licensee of their obligations under this Agreement.
